Terms of Service

The following contractual parameters govern all active service interfaces, project agreements, and creative asset deliveries between Brand For Sellers ("the Agency," "We," "Us") and any corporate entity, private label operator, or e-commerce merchant ("the Client," "You") utilizing brandforsellers.com or commissioning professional visual architecture.

By initiating a service brief, executing a digital project estimate, or submitting data via our user interface forms, you explicitly acknowledge, accept, and bound your enterprise to these terms. If you do not agree to these terms, you must halt all interactions with our design workflows immediately.

1. Operational Scope of Services

Brand For Sellers provides elite, design-led brand strategy specifically focused on e-commerce optimization. This includes, but is not limited to, the creation of Amazon Listing Images, advanced infographics, custom product mockups, 3D high-fidelity product renders, A+ Content layouts, Premium A+ modules, and minimalist brand identity kits. All delivery criteria, image resolutions (4K/8K parameters), and project scopes are managed via custom quotes or statement-of-work (SOW) documents.

2. Intellectual Property and Asset Ownership

We maintain precise boundaries regarding creative asset licensing to guarantee operational and commercial security:

  • The Retention of Draft Rights: All preliminary concepts, wireframes, prototype drafts, rough 3D render mockups, layout variations, and unselected design pathways developed during a project remain the exclusive intellectual property of Brand For Sellers.
  • Transfer of Commercial Ownership: Upon completion of the project, and only when the final invoice balance is settled and paid in full, full commercial usage rights and ownership of the final approved visual assets (e.g., exported flat graphics, finalized A+ banners) transfer completely to the Client for use on Amazon or their direct sales platforms.
  • Source File Exclusions: Unless explicitly written into a specific premium contract agreement, our standard project quotes do not include the transfer of native, raw master development files (such as layered Adobe Illustrator .AI profiles, Figma files, raw 3D master mesh files, or custom CSS scripts).

3. Client Responsibilities and Specifications

To meet professional production timelines and high-end aesthetic goals, the Client is strictly responsible for providing accurate and timely information. This includes high-resolution raw product photography (where 3D modeling is not commissioned), precise product measurements, exact packaging dimensions, structural micro-mesh textures, flat labels, vector logo assets, and official branding colors. Brand For Sellers assumes zero liability for delivery delays caused by missing, incomplete, or inaccurate specifications from the Client.

4. Project Revision Bounds and Modifications

To protect agency capacity and prevent infinite design loops, all standard creative contracts include exactly **three (3) structural rounds of revisions** based on the original creative brief. Any requests for modifications that alter the fundamental scope of work (such as changing the structural shape of a product, altering the compartment counts of an approved asset model, or changing the core brand name) after work has commenced will trigger additional design fees billed outside the initial quote.

5. Financial Parameters and Payment Terms

All fees are explicitly quoted in USD, GBP, or CAD based on the client's localized marketplace. Standard project onboarding requires an initial upfront commitment retainer fee prior to asset development. Milestone or final balance payments must be paid immediately upon asset approval and before final unwatermarked files are transferred. All processing or currency conversion fees are handled entirely by the Client.

6. Strict Limitation of Corporate Liability

Brand For Sellers designs elite visual transformations to heavily optimize brand identity, click-through rates, and buyer interactions. However, we do not control international marketplace ecosystems or third-party platforms.

The Agency assumes absolutely zero operational, legal, or financial liability for:

  • Fluctuations in the Client's Amazon conversion trends, ad spend metrics, organic keyword indexing, or overall daily sales performance.
  • Any listing suppressions, suspension loops, brand registration blocks, or account flags executed by Amazon's internal automated algorithms.
  • Copyright disputes arising from brand names, trademarks, or raw images supplied to us by the Client without proper commercial clearance.

7. Contract Termination Parameters

Either party may terminate a running design agreement if the other party breaches their contractual obligations and fails to correct the issue within seven (7) business days of receiving notice. If the Client terminates an active contract before completion, Brand For Sellers retains the initial project retainer fee to cover executed creative hours, asset rendering cycles, and administrative overhead.
